General terms and conditions for bookings of the Casa Malinas holiday home.

1. Parties and celebrations are not allowed
Your booking must be for holiday purposes only.

The accommodation may not be used for gatherings such as weddings, bachelor parties, dance parties and other parties or parties. If a certain hierarchy is determined, this entails the immediate termination of the rental. In that case, the tenant is not entitled to any compensation or reimbursement of amounts paid.

Meetings for business purposes are permitted.

2. There may not be:
fireworks, Chinese lanterns, firecrackers, etc. are set off

drone is operated on site

firearms are present on the premises

electric bicycle or vehicle must be charged via the standard sockets in the house and not in the large shed due to fire risk.

You can charge the batteries of electric bicycles in the sockets provided for this purpose.

3. Arrival
The accommodation is available from 4:00 PM on the first day of your booking. Different terms and conditions apply for business purposes.

4. Departure
Return furniture and dishes to their original places

Vacuuming

Place bed and bath linen in the technical room on the ground floor

Dirty dishes: wash/place in the dishwasher and run

Empty refrigerators and freezer completely

Collect rubbish in the correct roll container: Rest (grey), PMD (blue) and Paper (yellow). Organic waste in the compost bins in the garden. Take the glass yourself to the glass containers next to Jeugdhuis 't Paenhuys in the Stoopkensstraat in Hoegaarden.

Scoop dog feces from the lawn and sidewalk

Dogs peeing against a wall or on the patio: pour a bucket of water and scrub with a hard brush

Turn off lights

Close windows and doors

Small effort, big fun! If the landlord has to do the above on your behalf, if the textiles with spots have to be taken to the dry cleaner, etc., the costs of this will be retained from the deposit. Cleaning hourly rate: see table

The tenant must leave the property at the correct time on the departure date. If you leave at a later time, the tenant must pay an additional rental amount. Additional rental amount see table.

5. Permitted number of people on site
With the exception of children up to 2 years old, the number of people using the accommodation and grounds for overnight stays may not exceed 12.

You may not invite additional guests for an overnight stay during your stay. This affects fire safety and brand insurance.

Different terms and conditions apply for business purposes.

6. Dogs
You may bring a maximum of two dogs. Other pets are not allowed. Dogs are not allowed on the floors.
Dogs are not allowed in the seats or on the seats.
There are sun loungers and baskets.

When departing a company with dogs:

Vacuuming: do not leave any hair behind

Scoop droppings from the lawn and sidewalk

Puddles against a wall or on a patio: pour a bucket of water and scrub with a stiff brush

7. Bookings
Bookings are for the holiday home, excluding the meeting room on the first floor. For business concrete us to solve.

You must formalize telephone bookings by submitting a request by e-mail to the landlord of a booking on a booking platform.

Bookings are always confirmed by the landlord by e-mail, without a confirmation e-mail no reservation has been made.

You have 5 days from the confirmation email to transfer the deposit. Amount of guarantee see table.

The full rental price must be paid no later than 30 days before the rental period. You will receive an invoice for this.

Cancellation insurance is not included in the booking/rental price. The landlord requires the tenant to take out trip cancellation insurance.

Payment of all required amounts when due is essential. If payment is not made on time, the landlord can cancel the booking on behalf of the owner.

Bookings must be submitted for our normal booking periods and are for a minimum of 2 separate nights.

In case of bookings for more than one week, we provide normal bed linen and towels.

When you make a booking it means that you are over 18 years of age and you accept full responsibility for all persons who will use the property during the period booked and you have read and accepted the current Terms and Conditions.

8. Cancellation by the tenant
If you cancel for any reason, you must inform the landlord via the same channel on which the reservation was made. Cancellations are confirmed by the landlord by e-mail.

9. Amount of cancellation costs
If you cancel your stay more than 30 days prior to the rental period: the deposit.

If you cancel your stay within 30-14 days prior to the rental period: 50% of the rental price.

If you cancel your stay within 14 days prior to the rental period: 100% of the rental price.

10. Cancellation by the landlord
We may cancel a booking at any time before it begins. We expect to only have to do this in cases of force majeure, due to essential construction work, an issue related to Covid-19, or for any other reason unforeseen by us at the time your booking was accepted. In this unlikely event, we will refund any money received by us for the booking in full, but no further compensation will be payable, including for travel and other expenses incurred by you in connection with the booking.

11. Cancellation due to Covid 19
If a stay cannot continue due to measures taken by the Belgian or a local government, then this is possible

or a rebooking to another date that falls within 2 years after the original rental period

or a refund of the amount already paid
However, Covid 19 / quarantine at (one of) the tenants cannot be invoked as a reason for cancellation, in which case the tenant must rely on trip cancellation insurance.

12. Rebooking
In some cases we can transfer bookings to a new date once, if requested no later than 60 days before the start of the holiday.

13. Payments
All payments must be transfers in EURO.

We do not accept vouchers or vouchers as a means of payment.

14. Administration costs
We do not charge any administration costs.

15. VAT
Our rental prices include VAT.

If VAT rates change, we reserve the right to adjust our prices accordingly.

16. Loss or Damage
When you book, you agree to reimburse us for all loss and damage arising (including greater than normal and reasonably expected amounts of cleaning) directly or indirectly to the property and its contents through any intentional or negligent act or omission by you, or any person or animal accompanying you, and, without limiting the foregoing, to immediately pay us the costs of compensation for such damage and cleaning. The costs may include requiring work from specialized professionals.

17. Problems during your stay
You can email complaints until 10 p.m. on the day of arrival.

If you experience any problems with the holiday home after 10 p.m. on the day of arrival during your stay, you must report this as soon as possible to the landlord by e-mail, not to a third person. The landlord's email address appears on the first page of the current General Terms and Conditions.

The landlord will not provide refunds in relation to complaints submitted after the tenant's departure from the holiday home if the customer has not communicated the complaint or problem to the landlord in accordance with the above during the stay.

When handling a complaint, we take into account whether we have been given the opportunity to investigate it and the opportunity to put things right.

18. Working in the area
We accept no liability for any works or activities of any kind taking place on any land adjacent to or in the vicinity of our property, nor are we responsible for asking any questions about the likelihood of, or providing you with information about , such works or activity.

19. Access by the landlord
The landlord, his representative and the cleaners have access to the holiday home during your stay. It is rather unlikely that this will happen.

20. Limitation of Liability
Our liability to you and those accompanying you at the accommodation is strictly limited to direct damages up to the amount paid by you on the booking but this does not include our liability for which liability cannot be legally excluded.

We will not be liable to you at all for any indirect or consequential loss or damage, whether caused by negligence, breach of contract or otherwise. We will also not be liable to you for any noise or nuisance from neighbors or other activities outside the property, including agricultural and street noise.

21. Lessor's rights and obligations
The landlord undertakes to deliver the holiday home to the tenant clean and in good condition at the agreed time.

The landlord may view the holiday home at any reasonable time. See point 19.

The landlord

is not liable for: damage or injury arising as a result of a stay on its premises or by the use of the facilities available on its premises; claims for damages arising from nuisance caused by third parties; information provided orally or by telephone; facilities or facilities becoming disabled or out of use. This is without prejudice to mandatory legal provisions.

The landlord is not liable for theft or damage to the tenant's property.

The landlord is entitled to cancel the booking without notice of default or judicial intervention being required:

if the landlord has not received the deposit and full rental amount at the start of the rental period
if the tenant has not fulfilled his obligations as laid down in the current General Terms and Conditions
In the event of damage, the landlord may deduct the costs for repairs from the deposit. The landlord decides on the deposit.

The deposit or the balance thereof will be refunded to the tenant within 7 days after the end of the rental period.

22. Tenant's rights and obligations
The tenant is deemed to have accepted the rented property and its inventory without damage, unless he has informed the landlord by e-mail before 10 pm on the day of arrival.

The tenant may not sublet the holiday home to third parties, grant use of it, nor allow more than 12 people to spend the night there.

The tenant will use the holiday home neatly and cleanly and undertakes to report and compensate immediately and on his own initiative by e-mail any damage caused by his actions or negligence to the holiday home, the furnishings, household goods or otherwise. The tenant is also obliged to compensate any missing part of the rented property, furnishings or household goods.

The tenant is responsible for ensuring that no nuisance is caused to the neighborhood. This means, among other things, that: no decorations are applied or (party) tents are placed and that outdoor sound equipment is not audible more than 5 meters away from the home.

The tenant is allowed to drive on the cobblestone road to the large barn with a motorcycle or car, but not on the lawn.

The tenant is responsible for ensuring that the house rules, which are visibly displayed in the home, are complied with.

Although the information provided to you is correct at the time of publication, we reserve the right to change any prices, services or other details contained in any published information at any time before entering into a booking with you.

These conditions are valid for bookings made from November 2, 2022

Table of rates applicable from 2022

Deposit: EUR 500

If you leave at a later time, the tenant must pay an additional rental amount, amounting to EUR 50/hour

If the landlord has to do the following on your behalf, if the textiles with spots have to be taken to the dry cleaner, etc., the costs will be deducted from the deposit. Hourly cleaning rate: EUR 30/hour
